Just returned from yet another cold swim. This used to be a great time of the year for a dip but I have realised that since all our complaints about the water temperature are fobbed off it must be because the staff responsible are not competent enough to control the temperature. I hope next year that they employ some more experienced staff.
Hi Dave. Here is an update on the request by several owners for infomation on
holding back of of a portion of site fees. As promised in the last newsletter
i contacted Trading Standards. Having outlined the implied breach of
contract and now have the backing under complaint number ID 22744. Trading
Standards have passed the complaint under the C/ID no. to Poole Consumer
Protection Service who have actioned the complaint under case number
114089.I and any other owner who paid their site fees by credit card can
claim from their cc company as can cash payers by county court action for
£25.I however have chosen to put £350 into dispute (not pay) under the above
case number.
For those who choose to reclaim last years over payment. This is done under
1974 CONSUMER CREDIT ACT: don’t be fobbed of by the c/c claims that claims
have to be lodged in 180 days. Under this act 6 year liability applies.
Those who choose to withhold a portion of this years charges need to inform
Bourne as soon as possible and put the amount into dispute under the above
case number. In both cases the claim is: BREACH OF AN IMPLIED TERM OF THE
CONTRACT. Namely by taking a full set of site fees without making it
abundantly clear that the expectations of the contract would never be
met. Giving absolute disregard for clause 22 of the Bourne agreement for
the siting of caravans. Any further information can be obtained from the
writer. Just a footnote. The £100 discount will tho lost initially form part of
the eventual settlement.
