I am sorry to bother you but i would ask that you take just a couple of minutes to read this e mail as it may be of a benifit to you later on.
My husband and i own a Caravan at Hafan-Y-Mor in Pwhelli, it is on a Haven site which as i am sure you know is now Bourne Leisure.
We have been on the site since May 2001 first having owned a second hand Atlas Moonstone this became a little small for our twins and 6 year old son so we upgraded to a new Carnaby Claret in June of 2002. Paying £10,517 in cash and £12, 300 in finance. Upon delivery there were some 45 faults but the most serious was a non functioning toilet and a faulty cooker, the toilet took 28 days to repair in which time i lost four weeks of bookings resulting in a loss of £1800,00 in income.
Upon the advice of Trading Standards we asked for compensation from Bourne Leisure and the finance company.
This now becomes the purpose of my writing, the Finance Company, Capital Bank of Chester wrote back saying we were in contravention of our finance agreement by letting the caravan out, as it clearly states that you should not hire the "vehicle". (Terms and Conditions Paragraph 4 Item C) When the agreement was signed I queried this and was told that it only applied to vehicles as did the following clause that I was unable to race the vehicle!
We have now been told by Bourne Leisure we can let the van out but the Finance Company insist we can't as its contravention of the finance agreement which could result in the repossession of the caravan.
Upon applying for insurance we have been told that all insurance would be null and void
1) for malicious damage, as we shouldn't be letting out
2) if we were broken into we would not be covered as we had given the keys out to people that were not authorised to have them by the Finance Company.
As we stand today we have the backing of our solicitor who is trying to get our £10,517.00 deposit back for us, Trading Standards, the National Association of Caravan Owners, and Which? magazine.
In the Spring Issue of Holiday Caravanner which is produced by the Nation Association of Caravan Owners, there appears an article on sub letting your caravan either through Bourne Leisure's sub letting scheme or privately, in which it states another finance company "Black Horse Finance" forbid Sub Letting" in their agreements. Unfortunately Bourne Leisure have refused to comment but are about to be visited by Hemel Hempstead Trading Standards. If you have a Caravan bought on Finance please look at your agreement and if
