This was my grandfathers money that he has saved up all his life and I
am not going to let it go without a fight, but need straight down the line advice
am i going to have a chance of winning the fight.

this is what I have sent to bourne leisure today as I was furious at the crap the
sales office gave us. Only reason we are selling is we are moving to Scarborough
and dont need a caravan at Scarborough. I have a good mind to stand outside the sales
office every day and catch all the people going in to let them know they are losing
all their money.

How do I make a complaint and who do I make it to.
I brought someone onto the site
today (Blue Dolphin)to buy my caravan this was after i spoke to Sue who informed
me that the site did not buy the caravans back as Bourne Leisure had stopped that,
I contacted Bourne Leisure and this is not the case.
I put the van for sale for 12000
only to find the buyer would have to had paid a lot more than that, none of which
was explained. After both seeing Sue I sat and listened to her tell my buyer she
was not aware of the sale yet she herself had told me to sell privately. then gave
me some figures written on Bourne Leisures private sale agreement stating the offer
price. No offer price was made as I had already been told the site couldn't buy the
van. Me turning up with a buyer today caused a bit of a fuss I suspect as none of
the figures had been explained or gone through until we arrived. I then came home
to read through my agreements.
I asked for a settlement figure with Evergreen which
has always been a nightmare as they blame the site for not setting up the direct
debit mandate.they said settlement was £4120 yet the agreement says the consumer
credit act says they have to give us early settlement rebate. We were told we have
to pay 15% commission yet your areement says this is at the discretion of the site
and is not compulsory at all.
We only came onto the site in August with our first
van paid cash in full, lost on that and upgraded in October and according to my owners
exclusive account you have had £18693.92 out of me since last September and if we
sell and leave things as it stands we leave with £3747. Sue told us problem was no
one wants the 10ft caravans, no one told us that when we bought it and you are advertising
a 10ft on your dolphin site for £24000. If the age and size of the caravan is a problem
then we were mis sold the caravan in the first place. I am absolutely outraged at
the whole situation and want the complete truth about how we sell this van, what
it is worth as its obviously not scrap value sold to a trader and if it is, then
I want our money refunding as you were quite prepared to let it for the next 2 years
and if it is only worth trade value we were missold it and will have to get trading
standards to look at the case.
We were told £2200 site fees would be coming back but
now because of the rubbish we were told it drops to 40%. We have been lied to, misinformed
and i am not happy in the slightest and would like a reply or phone call today 4/4/08,
before I move onto trading standards for mis selling.
After sending the first email I got a bit on one and decided to pick their agreement
apart, see if you agree please.
Just a addition to our initial complaint,
section
20 of the code of practice states A caravan owner may reasonably expect to receive
a fair price for his caravan if he chooses to sell -
Section 22 the park owner may himself make an
offer to purchase, we were told the site was not allowed to do that.
section 23 c
the park owner can advise of the price -
section 24 commission
shall be at the discretion of the park, no mention of any discretion there. commission
MAY be subject to VAT no may there either, it was sold to us as that is how it is
15% plus VAT.
section 27g I did not know until today because my buyer asked that the
rates and water were due in May, I thought they were included in the site fees as
on my agreement they were added into there, so a tad of mis selling there I think.
